SPONSORING ORGANIZATION: The name of this Giveaway is the KIDZ BOP Social Media Giveaway (“Giveaway”). The Giveaway is sponsored by the Society of Health and Physical Educators dba SHAPE America (“SHAPE America” or “Sponsor”).

DESCRIPTION: Individuals who submit a video of themselves dancing along to selected KIDZ BOP dance break videos and post the videos on social media with the hashtag #SHAPENOLA and tagging by @SHAPE_America and @KIDZBOP will automatically be entered into a random drawing for a chance to win one (1) free registration for the 2022 SHAPE America National Convention and Expo in New Orleans, LA, April 26-30, 2022.

GIVEAWAY PERIOD: Individuals meeting the eligibility requirements set forth below may enter the Giveaway between 10:01 a.m. (EDT) April 5, 2021 and 11:59 p.m. (EDT) April 23, 2021 (“Giveaway Period”).

ELIGIBILITY: By participating, entrants agree to be bound by these official rules (“Official Rules”) and the decisions of the Sponsor. Entries received after the expiration of the Giveaway period are not eligible to win.

1. Must be a U.S. citizen and at least eighteen (18) years of age at the time of registration; and
2. Must submit a video as outlined in the How to Enter section below; or
3. Enter the giveaway through the Alternative Entries process detailed below.

Paid employees of KIDZ BOP, SHAPE America or SHAPE America vendors/suppliers, SHAPE America Councils, Board of Directors, District Council Leadership, and SHAPE America Committee members and their immediate family members (spouse, mother, father, in laws, grandmother, grandfather, brother, sister, children and grandchildren) or those living in the same household are not eligible to win.

The Sponsor reserves the right in its sole discretion to disqualify and eliminate any entry from any entrant for any reason, including but not limited to, because the Sponsor believes the entry does not comply with these Rules.

HOW TO ENTER: No purchase or donation is necessary to enter or win. A purchase or donation will not increase your odds of winning.

1. Posting a video of entrant dancing along to one of the KIDZ BOP videos featured in Giveaway promotions or the KIZ BOP Daily Dance Breaks featured during the 5:00 p.m. EDT Wellness Sessions scheduled on Wednesday, April 14 – Friday, April 16, 2021 during the 2021 SHAPE America Virtual National Convention & Expo. Each video post must include the following, in addition to the video:
1. Tag both @SHAPE_America and @KIDZBOP with the video post
2. Follow both SHAPE America and KIDZ BOP on social media
3. Include the hashtag #SHAPENOLA with the video post; or
2. (“Alternative Entries”) Submitting his/her full name, address, phone number, email address to the Giveaway Form

All entries must be received by Sponsor prior to the expiration of the Giveaway Period. Limit one entry per person

PRIZES AND ODDS OF WINNING: Pursuant to these Official Rules, Sponsor shall award to individual one (1) free full convention registration (Non-Member Registration) for the 2022 SHAPE America National Convention & Expo in New Orleans, LA, April 26-30, 2022 (“Prize”). The verifiable retail value of the Prize is for the full value of the non-member registration, including a one-year SHAPE America Select Professional membership, up to $550. Any other charges, including ticketed events, or workshops (along with respective taxes) to be paid at the registrant’s expense. Limit one entry per person.

The Prize shall be awarded through a random drawing from the entries Sponsor receives during the Giveaway Period. The odds of winning depend on the number of eligible entries received. The decision of the Sponsor regarding the selection of winner shall be binding. Winners may not substitute, transfer, or assign Prizes. No Prize can be redeemed for cash or replaced if lost or stolen. Sponsor reserves the right to replace and/or substitute a like prize of equal value, should the specified Prize be unavailable for any reason.

SPONSOR MAKES NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS TO THIS GIVEAWAY OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING THE PRIZE OR ANY COMPONENT OF THE PRIZE.

WINNER NOTIFICATION: The Prize drawing shall be conducted on or before May 7, 2021 and the winner will be notified by phone, email or mail. Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected from among all remaining eligible entries. If a potential winner cannot be contacted or does not respond to Sponsor within seven (7) calendar days from the date Sponsor first tries to notify winner, such potential winner forfeits all rights to win the Giveaway or receive the Prize, and an alternate winner may be selected from all remaining eligible entries.

Sponsor is not responsible for late or misdirected Prize notifications and Sponsor reserves the right in its sole discretion to determine remedies, if any, to Prize fulfillment issues.

PARTICIPATION: By entering the Giveaway, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the Sponsor which shall be final and binding in all matters relating to this Giveaway.

This Giveaway is void where prohibited by law. Sponsor does not warrant that the Giveaway is valid in any particular state or jurisdiction. All applicable federal, state and local law and regulations shall apply.

Except where legally prohibited, each winner grants (and agrees to confirm the grant in writing if requested) permission for KIDZ BOP, SHAPE America, their advertising and promotion agencies, and those acting under their authority to use his/her name, photograph, voice and/or likeness, for advertising, trade and/or publicity purposes without additional compensation.

Submission of contact information in connection with this Giveaway (whether or not required), including mailing address, phone number, and/or email address, during entry constitutes permission for Sponsor to add entrant to Sponsor’s customer database and to contact entrant in the future for promotional and other reasons. Entrant may opt-out of receiving such communications as set forth in Sponsor’s Privacy Policy or as provided within any such marketing materials (e.g., using the unsubscribe feature provided in the footer of Sponsor’s emails).

WINNERS’ RESPONSIBILITY FOR TAXES: Winners are solely responsible for any and all expenses, and applicable federal, state and local taxes. If applicable, all winners should expect to receive a tax form 1099 for the value of the Prize as provided by current tax laws.

SPONSOR’S RIGHT TO SUSPEND OR TERMINATE GIVEAWAY AND MODIFY OFFICIAL RULES: In the event the Giveaway is compromised in any way which corrupts or impairs the administration or fairness of the Giveaway, Sponsor reserves the right, in its sole discretion, to suspend or terminate the Giveaway at any time. Such events may include, but are not limited to, computer viruses or a security breach. Should the Giveaway be suspended or terminated prior to the expiration of the Giveaway Period, Sponsor reserves the right to award Prizes based on eligible entries received prior to the termination date. Sponsor reserves the right to amend these Official Rules at any time.

ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

LIMITATION OF LIABILITY: Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. KIDZ BOP, SHAPE America, and their respective affiliates, officers, directors, employees and agents do not have and will not have any liability whatsoever for, and shall be held harmless against any liability for any injuries, losses or damages of any kind to persons, or property resulting in or in part, directly or indirectly, from acceptance, possession, misuse or use of any Prize or participation in this Giveaway or any Giveaway-related activity; or for any typographical or other error in the printing, offering or announcement of any Prize. Should a court of law find Sponsor or KIDZ BOP liable for loss or damage, Sponsor’s and/or KIDZ BOP’s liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall Sponsor or KIDZ BOP be liable for attorney’s fees.

KIDZ BOP, Sponsor, and their affiliates, officers, directors, employees and agents will have no liability whatsoever for entries that are late, incomplete or not received for any reason.

GOVERNING LAW AND JURISDICTION: All issues concerning the construction, validity, interpretation and/or enforceability of these Official Rules or the rights and obligations of entrants in connection with the Giveaway shall be governed by and construed in accordance with the laws of Virginia without giving any effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. By entering into this Giveaway, each entrant consents to have all disputes resolved in the Fairfax County, VA Circuit Court. Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any Prize awarded shall be resolved individually, without resort to any form of class action.
